Terms and Conditions
Effective Date – 19th October 2026
Welcome to the St George’s Mall website (www.stgeorgesmall.com.mt). Please read these Terms and Conditions carefully. They apply to the use of the Website, visits to the Mall, use of the Car Park by Mall guests and use of Guest Wi-Fi.
About Us
These Terms and Conditions (the “Terms”) are used by DB Gauci Shopping Mall Limited (C-82284) (“we”, “us” or “our”), which operates the St George’s Mall Website and manages St George’s Mall.
1) Scope, Acceptance and Priority of Terms
By accessing or using the Website, visiting the Mall, the Car Park, or connecting to Guest Wi-Fi, you automatically agree to comply with these Terms. If you do not agree, you must refrain from using the relevant service or facility. Specific circumstances or services, such as events, competitions, promotions, vouchers, bookings, car-park tariffs or retailer offers, may be governed by additional terms displayed online or at the relevant location.
Those specific terms shall prevail to the extent of a direct inconsistency with these Terms. Mandatory rights under applicable law always prevail over these Terms. Nothing in these Terms creates a tenancy, licence to occupy, agency, partnership or employment relationship between you and us.
2) Definitions
In these Terms:
- “Car Park” means the parking areas, entrances, exits, ramps, access roads, pedestrian routes, payment equipment and related facilities serving the Mall.
- “Guest Wi-Fi” means any public wireless internet service made available by or on behalf of the Mall.
- “Mall” means St George’s Mall and its common areas, entrances, internal and external areas and facilities under our management, and includes the Car Park.
- “Retailer” means an independent shop, restaurant, service provider, concessionaire, other occupier operating within the Mall (such as our tenants) or any third party temporarily permitted to operate within the Mall.
- “Website” means www.stgeorgesmall.com.mt and any official webpage or digital service operated by us on which these Terms appear.
- “you” means a Website user, Mall visitor, Car Park user or Guest Wi-Fi user, as the context requires.
3) Eligibility and Use by Minors
Minors may access and browse the Website and may visit the Mall if accompanied by an adult. Certain services, activities, promotions, competitions or other opportunities offered through the Website or at the Mall may be subject to age restrictions or may require the consent or authorisation of a parent or legal guardian. Where such consent or authorisation is required by law or by the applicable terms of the relevant activity, a minor may not participate unless the necessary consent or authorisation has been obtained. We reserve the right to request appropriate confirmation of age and, or parental or guardian consent.
You are reminded that parents, guardians and adults generally will be held responsible for supervising minors in their care, including their use of the Website, Mall facilities (including, for the avoidance of doubt, lifts and escalators) and Guest Wi-Fi.
For the avoidance of doubt, minors must always be in the company of an adult when using the escalators.
We may ask for reasonable proof of age or authority and may refuse or cancel access where eligibility requirements are not met.
4) Permitted Use of the Website
You may use the Website for personal, non-commercial and lawful purposes. You must not:
- use the Website fraudulently, unlawfully or in a manner that infringes another person’s rights;
- gain or attempt to gain unauthorised access to any system, account data or restricted area;
- introduce malware, malicious code or material designated to disrupt, damage or overload the Website;
- scrape, crawl, harvest, frame, mirror or systematically extract Website content or data without our prior written permission, except where applicable law does not permit such restriction;
- impersonate another person, misrepresent your affiliation, or submit false or misleading information;
- circumvent security, access-control, rate-limit or technical-protection measures; or
- use the Website for advertising, solicitation, resale or another commercial purpose without our prior written permission.
Please note that you are responsible for your device, internet connection, account credentials and activity carried out through your account. You must keep credentials confidential and notify us promptly if you suspect unauthorised use.
5) Website Information and Availability
The Website provides general information about the Mall, including Retailers, opening hours, promotions, events, facilities and news. We take reasonable care over information we publish, but details may change and errors may occur. Information about Retailer/s or third party event organisers, including their stock, opening hours, prices, menus, promotions and event arrangements or related information, as applicable, should be confirmed with the relevant Retailer or organiser.
Unless expressly stated otherwise, Website content is provided for general information and does not constitute professional advice or a binding offer. We do not guarantee that the Website will always be available, uninterrupted, secure or free from errors or harmful components.
We reserve the right to maintain, suspend, restrict, withdraw or change any part of the Website, our services as well as our facilities.
6) Retailers
Each Retailer is an independent business and is responsible for its products, services, prices, warranties, promotions, staff and customer service. A purchase or booking with a Retailer is a contract between you and the Retailer. We are not responsible for the Retailer’s relationship with its customers.
7) Events and Promotions
Competitions, promotions and events generally may have separate eligibility, entry, prize, cancellation, publicity and data-protection terms. You must read those terms before participating. We may reasonably refuse invalid, late, automated, fraudulent or duplicate entries.
We reserve the right to amend, postpone or cancel any competition, promotion or any other event without prior notice.
We remind you again that we do not take responsibility for any such events organised by Retailers or other third parties, even if these are located within the Mall.
8) Intellectual Property
The Website and all content made available through it, including names, trademarks, logos, text, photographs, graphics, images, videos, software, databases, layout and design, are owned by or licensed to us and are protected by applicable intellectual property laws. All rights are reserved. Retailer, brand and other third-party names, trademarks and logos are the property of their respective owners.
We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Website for your personal, non-commercial use only. Except as expressly permitted by law or with the prior written permission of the relevant rights holder, you may not copy, reproduce, modify, adapt, distribute, publish, display, transmit, commercially exploit, scrape, extract or systematically collect any part of the Website or its content, create derivative works from it, or use any trademarks, logos or other protected material.
Nothing in these Terms grants you any ownership or other intellectual property rights in the Mall, the Website or its content.
9) Third-Party Links and Embedded Services
The Website may contain links, maps, social-media features and embedded services provided or operated by third parties for your convenience. We do not control or endorse such third parties and are not responsible for their content, availability, security or privacy practices. When you access or use any third-party website, feature or service, your use is subject to the applicable third party’s own terms, conditions and policies.
10) User Submissions
If you submit an enquiry, review, photograph, feedback, competition entry or other material, you confirm that it is accurate where it states facts, that you have the right to submit it, and that it does not infringe the intellectual property, privacy or other rights of any person or contain anything unlawful, defamatory, threatening, discriminatory, obscene, misleading or harmful.
You retain ownership of your material. To the extent necessary for us to respond to you, administer the relevant service, activity or promotion, or use material that you have asked or clearly agreed that we may publish, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, publish and communicate that material for the relevant purpose. We may moderate, refuse to publish or remove material that we reasonably believe breaches these Terms or applicable law. Any personal data contained in or associated with your submission will be handled as described in the applicable Privacy Notice.
11) Visitor Conduct
We want the Mall to be safe, welcoming and accessible. While at the Mall, you must behave lawfully and with reasonable consideration for visitors, Retailers, contractors, staff as well as third parties generally. You must comply with safety notices and reasonable directions from Mall management, security personnel and emergency services. You must use all facilities and equipment (including lifts and escalators) safely and responsibly.
You must not:
- threaten, harass, intimidate, abuse, discriminate against or endanger any person;
- fight, act violently, carry an unlawful weapon, or engage in illegal, disorderly or indecent behaviour;
- dirty, damage, deface, misuse or remove property (including in the bathrooms), interfere with safety equipment, or enter staff-only, closed or restricted areas;
- smoke or vape (unless outdoors);
- consume alcohol outside licensed premises or possess, use or supply illegal drugs;
- use bicycles, skateboards, roller skates, hoverboards, scooters or similar devices inside the Mall, except mobility aids used responsibly and if necessary;
- obstruct entrances, exits, walkways, lifts, escalators, fire routes or accessibility facilities;
- beg, busk, canvass, distribute materials, conduct surveys, advertise, sell, solicit donations, protest as an organised activity, or undertake commercial filming or photography without prior written permission;
- operate a drone or other remotely controlled device; or
- create excessive noise, alarms, offensive displays or another nuisance that interferes with others’ use of the Mall.
Personal, non-commercial photography is generally permitted in common areas if it is lawful, unobtrusive and respects privacy and security instructions. Photography or recording may be restricted by us for safety, privacy, intellectual property or operational reasons.
12) Children, Animals and Accessibility
Children must be appropriately supervised. Play areas and family facilities, where provided, may have additional displayed rules.
Animals are permitted only in accordance with current Mall signage and policy. In particular, for everyone’s safety, including the safety of your pets:
- Pets must be leashed or securely carried at all times;
- Owners must clean up after their pets and dispose of any waste properly;
- Owners must refrain from taking pets on escalators unless these are small pets that can be carried safely in hand;
- Customers with larger pets are to use lifts rather than escalators;
- Owners are responsible for preventing barking, aggression or disturbance to visitors;
- Pets should not be left unattended;
- The owner is responsible for any damage or injury caused by their pet; and
- Mall security may require an animal to leave the premises if it poses a safety, hygiene, or nuisance concern.
Assistance animals accompanying a person with a disability are welcome, subject to applicable law and reasonable safety requirements.
Mobility aids must be used safely and at an appropriate speed. Accessibility equipment and designated facilities must not be misused or obstructed.
13) Safety, Security, Searches and Emergency Instructions
Both uniformed and plain-clothed security personnel may operate at the Mall. Security personnel may ask you to identify yourself, explain your conduct, produce proof of purchase, consent to inspection of a bag or item, or leave a particular area. Any search requiring consent will not be carried out without it. Refusal may nevertheless result in refusal of entry or a request to leave the premises.
We may refuse entry to or require departure from the Mall, restrict future access or contact the police or emergency services where we reasonably believe a person has breached these Terms, committed an offence, created a safety or security risk, or disrupted the Mall (including any of the Retailers).
In an emergency or evacuation, follow announcements, signage and staff or emergency-service directions immediately. Do not use lifts or escalators where instructed not to do so.
14) CCTV and Incident Recording
CCTV and other security systems may operate in and around the Mall and Car Park for safety, security, incident investigation, crime prevention and the protection of people and property. Any personal data is processed under the applicable CCTV or Privacy Notice, which provides further information about the controller, retention, sharing and individual rights.
15) Lost Property and Unattended Items
Any lost property found within the Mall or the Car Park should be handed to Mall security. The Mall will take reasonable steps to securely store found items and to return them to their rightful owners, subject to satisfactory verification of ownership. Unclaimed items shall be dealt with in accordance with the applicable law. The Mall accepts no responsibility or liability for any lost, stolen or unclaimed property, or for any loss of or damage to property handed into its custody, except to the extent that such liability cannot lawfully be excluded.
16) Car Park: Basis of Use
Use of the Car Park is subject to these Terms, displayed signs, tariffs, height and weight restrictions, marked bays, access controls and reasonable instructions. By entering, you accept the applicable parking terms, including any applicable parking charges that may be charged for using the Car Park. For the avoidance of doubt, the Car Park is provided for parking vehicles visiting the Mall or other specific authorised destinations, and not for long-term storage, vehicle sales, repairs, washing of your vehicle, sleeping or other unauthorised purposes.
You are responsible and will remain responsible for your vehicle and its contents whilst the vehicle is in the Car Park. We accept no responsibility in this regard.
17) Car Park: Driver Responsibilities
A driver must hold all licences, insurance and authorisations required by law and must:
- obey road and parking bay markings, signs, barriers, speed limits, one-way systems and staff directions;
- drive responsibly and in accordance with the applicable law;
- use blue badge, accessible, electric-vehicle charging, loading or reserved bays only where entitled to by law and in accordance with displayed restrictions; and
- promptly report collisions, damage, spills, barrier strikes, lost tickets or safety hazards to Mall management.
18) Car Park: Charges, Access and Enforcement
Any parking charges and payment methods are those displayed at the Car Park at the relevant time. You are responsible for checking them before leaving the vehicle. A lost ticket or failure of a payment method will be handled under the displayed tariff and applicable law.
We may temporarily close, reserve or redirect spaces and entrances for safety, maintenance, emergencies, events or operational reasons. Access is subject to capacity and is not guaranteed.
Where a vehicle is parked dangerously, unlawfully, obstructively, in breach of displayed restrictions, or appears to have been abandoned, we reserve the right to take such lawful and proportionate measures as may be necessary, including issuing notices, contacting the vehicle owner or registered keeper, notifying the relevant authorities, and arranging for the removal or immobilisation of the vehicle where permitted by applicable law.
19) Guest Wi-Fi: Access and Security
Guest Wi-Fi is provided as a convenience and may require acceptance of additional on-screen terms or provision of limited registration details. Any such on-screen terms will take precedence over these Terms in the case of a conflict of interpretation between the two.
Access may be restricted by coverage, capacity, time, bandwidth, device number or technical requirements. We do not guarantee availability, speed, continuity, compatibility or security.
Public wireless networks may not be secure. You are responsible for protecting your device and communications, including by using current security software, secure websites and, where appropriate, a trusted virtual private network. Avoid transmitting sensitive information unless you have taken suitable security precautions. We are not responsible for the security of your device or of another user’s unauthorised activity.
20) Guest Wi-Fi: Acceptable Use
You must use Guest Wi-Fi lawfully and reasonably. You must not use it to:
- access, create, upload, download, store, transmit or distribute material that is unlawful, fraudulent, threatening, abusive, defamatory, discriminatory, obscene, exploitative, infringing or malicious;
- harass or monitor another person, invade privacy, infringe intellectual-property rights, or send spam or unsolicited bulk communications;
- gain unauthorised access, intercept communications, probe or disrupt networks, distribute malware, conceal unlawful activity, or circumvent security or content controls;
- operate servers, conduct high-volume automated activity, mine cryptocurrency, or consume disproportionate bandwidth; or
- commit, facilitate or encourage an offence or breach of another person’s rights.
We may suspend or terminate Wi-Fi access where reasonably necessary for security, maintenance, legal compliance, suspected misuse or fair network management. We may preserve or disclose relevant information where required or permitted by law, including in response to a valid request by a competent authority.
21) Privacy, Cookies and Electronic Communications
We respect your privacy and process personal data in accordance with applicable data-protection laws and our Privacy Notice, which explains how and why we collect, use, disclose and retain personal data and the rights available to you. Our use of cookies and similar technologies is governed by our Cookie Notice, which provides information about the technologies we use and the choices available to you. Where we send marketing or other electronic communications, we will do so in accordance with applicable law and our Privacy Notice. Please refer to our Privacy Notice and Cookie Notice, available on the Website, for further information.
22) Suspension and Enforcement
If we reasonably believe that you have breached these Terms or created a legal, operational, safety or security risk, we may take proportionate action, including removing content, restricting or suspending Website or Wi-Fi access, cancelling an invalid entry, refusing entry to or requiring departure from the Mall, preserving evidence or escalating the matter further, including by informing the relevant service provider, the necessary authorities, as well as the executive police.
23) Responsibility and Liability
To the fullest extent permitted by law, your use of the Website, Mall facilities, Car Park and Guest Wi-Fi is at your own risk. We will not be liable for any loss or damage arising from your acts or omissions, failure to take reasonable precautions, the acts or omissions of any Retailer or other independent third party for whom we are not legally responsible, interruptions or unavailability of services or facilities, or circumstances outside our reasonable control.
Where we are legally responsible, our liability is limited to loss or damage that is a reasonably foreseeable consequence of our breach of the law or our failure to exercise legally required care. We will not be liable for indirect or consequential loss except where the liability cannot lawfully be excluded or limited.
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
24) Events Beyond Reasonable Control
We are not responsible for any delays, interruption, closure or failure caused by an event beyond our reasonable control, including severe weather, utility or communications failure, fire, flood, epidemic, pandemic, civil emergency, industrial dispute, governmental restriction or security incident.
25) Changes to these Terms
We may update these Terms from time to time, including to reflect changes to our services, the operation of the Mall or Website, or applicable legal or regulatory requirements. Any updated Terms will apply to your use of the Website and, where relevant, the Mall from their effective date, which date is stated at the beginning of the Terms. By continuing to access or use the Website or relevant services after that date, you will be subject to the updated Terms. Where applicable law requires us to notify you separately of a change or obtain your consent, we will do so.
26) General Provisions
If any provision is found unlawful, invalid or unenforceable, it will be treated as modified to the minimum extent necessary or, if that is not possible, deleted; the remaining provisions continue in effect.
A failure or delay in enforcing a provision is not a waiver.
No person other than you and us has a right to enforce these Terms, except where mandatory law provides otherwise.
These Terms are available in English. If a translation is provided, the English version prevails to the extent permitted by law, but nothing in this paragraph limits a mandatory language or consumer right.
27) Governing Law
These Terms are governed by Maltese law and, subject to applicable consumer protection laws, the Courts of Malta shall have jurisdiction.
